With effect from 21 May 2004, CAWR introduces a duty to manage asbestos in non domestic
premises. Persons with repair and maintenance responsibilities for the premises will need to ensure that
asbestos containing materials within those premises are properly managed, and that information about
the location and condition of the materials is passed on to those likely to disturb them (regulation 4).

Approved Codes of Practice

These Regulations are subject to a number of Approved Codes of Practice (ACOP) issued by the
Health and Safety Commission, according to the form and location of the asbestos and the type of work
to be undertaken.
Except for asbestos contaminated land and for the uses defined below at paragraph 3.2, this ACOP
applies to:
4.1
Any work involving asbestos or asbestos containing products;
4.2
Any work with asbestos during manufacturing processes;
4.3
Any work on building materials that contain asbestos, including:
4.3.1 Asbestos
cement;
4.3.2
Any bitumen, plastic, resin or rubber materials that contain asbestos, for
whatever purpose;
4.4
Any work of brief duration on asbestos insulation, asbestos coating and asbestos
insulating board which is exempt from the requirement to license under regulation 3(2)(a) of the
Asbestos (Licensing) Regulations; and
4.5
Asbestos sampling and laboratory analysis.
4.6
Any work with asbestos insulation, asbestos coating and asbestos insulating board as
defined in the Asbestos (Licensing) Regulations (see definition below).
4.7
Employers carrying out similar work with asbestos insulation, asbestos coating and
asbestos insulating board on their own premises who are exempted from the requirement to hold a
licence under regulation 3(2) of the Asbestos (Licensing) Regulations.
Asbestos (Licensing) Regulations

The Asbestos (Licensing) Regulations require all work on or with asbestos insulation or asbestos
coating or asbestos insulating board to be subject to a Licence from the Health and Safety Executive.
The Licence details the Terms and Conditions under which the work may be carried out. A licence is not
required for work of less than 2 hours total duration, for air monitoring or sample collection to identify
asbestos, and where an employer is carrying out work with his own employees on his own premises.
