SUBSTANCES TO BE NOTIFIED

Schedule 1 of the `Notifications' Regulations lists the substances to which the Regulations apply, 
and the threshold quantities at which notification must be provided.  The schedule is reproduced at 
Appendix 1. The quantities refer to maximum storage capacity, not to actual amounts held at the time of 
notification, and the storage capacity within any establishment, even if in separate vessels, must be 
aggregated in order to decide how much is stored on that "site".  If the aggregation stored or in pipelines 
for each substance exceeds the notifiable quantity in tonnes, then the installation is notifiable to the 
HSE. 
THE DANGEROUS SUBSTANCES (NOTIFICATION AND MARKING OF SITES) REGULATIONS

The Dangerous Substances (Notification and Marking of Sites) Regulations1990 are intended to 
assist firefighting services by the providing advance and on site information which will allow them to 
operate in safety on sites containing large quantities of dangerous substances.  The site controller of a 
site containing 25 tonnes or more of dangerous substances must:  
6.1 
Erect suitable signs at access points to warn those entering the site of the existence of 
those dangerous substances; 
6.2 
Notify the appropriate fire and enforcing authorities, giving information specified in the 
regulations; 
6.3 
Erect suitable signs at individual locations on site warning of the presence, and nature of 
the hazard, of those dangerous substances, as directed by an inspector. 
EXCEPTIONS

Certain categories of premises are already subject to legal or other requirements which meet some 
or all of these requirements.  Schedule 1 of the regulations sets out all the exclusions, but the following 
are wholly excluded from application:  
7.1 
Dangerous substances which have been buried or deposited in the ground at the site as 
waste (whether in bulk, in drums or in other containers); 
7.2 
Substances which are dangerous substances by reason only that they are radioactive 
substances; 
7.3 
Substances which on classification under the Classification and Labelling of Explosives 
Regulations 1983 (SI 1983/1140) have been assigned to Class 1 within the meaning of those 
regulations; 
7.4 
Aerosol dispensers unless they are labelled in accordance with legal requirements or 
would be required to be so labelled if they were being supplied or conveyed by road.

The regulations apply in respect of all dangerous substances, being any substance classified as 
dangerous in the:

goods by road and rail other than explosives and radioactive material:
